Welcome to Kalaadhara (kalaadhara.com) ("Kalaadhara," "we," "us," or "our"). This website is operated by Kalaadhara and powered by Shopify. These Terms and Conditions constitute a legally binding agreement made between you ("you," "your," "User," or "Customer") and Kalaadhara, including its founder and lead artist, Army Bhanderi.

1. Acceptance of Terms & Applicability

By accessing our website and/or purchasing our products (including but not limited to 3D printed articles, oil paintings, Tanjore art, resin art, crochet, and corporate gifts), you explicitly agree to be bound by these Terms and Conditions. These terms are governed by the Information Technology Act, 2000, and the Consumer Protection (E-Commerce) Rules, 2020 of India. If you do not agree to all terms and conditions in their entirety, you are strictly prohibited from using this website or purchasing our products.

2. Unilateral Right to Refuse or Cancel Orders

Kalaadhara reserves the absolute and unilateral right to refuse service, limit product quantities, or cancel any order at our sole discretion, at any time, for any reason.

  • Pricing & Typographical Errors: We reserve the right to correct any pricing or descriptive errors. If an order is placed at an incorrect price, we retain the right to cancel the order and refund the payment, regardless of whether an order confirmation was sent.

  • Custom Commissions: Custom work commences only after design approval and full or partial payment. Once production, 3D printing, or painting has begun, custom commissions are strictly non-refundable. Timelines provided are good-faith estimates, not guarantees.

3. Strict Intellectual Property & Anti-Piracy Policy

All content, designs, artworks, and blueprints on this site—including 3D models, painting compositions, resin designs, crochet patterns, digital downloads, logos, and images—are the exclusive intellectual property of Kalaadhara and Army Bhanderi. They are aggressively protected by Indian and international copyright laws.

  • Physical Ownership Only: Purchasing a physical product grants you ownership of that specific physical item solely for personal, non-commercial use. It does NOT transfer any copyright, moral rights, or reproduction rights to the buyer.

  • Zero Reproduction Rights: You are expressly prohibited from copying, reproducing, reselling, or commercially distributing our products, prints, or images.

  • Anti-Reverse Engineering Clause: You explicitly agree not to 3D scan, reverse engineer, recast, mold, or digitally replicate any physical 3D printed or resin product purchased from Kalaadhara. Any violation of this clause will result in immediate legal action for IP infringement and damages.

4. Product Descriptions, 3D Printing & Handmade Variations

All products are provided strictly on an "AS IS" and "AS AVAILABLE" basis.

  • Inherent Variations: Because our offerings include handcrafted art (Oil, Tanjore, Crochet, Resin) and additive manufacturing (3D printing), slight variations in color, texture, size, finish, and structural layer lines are natural, expected characteristics of the creation process.

  • Not Defects: These variations—including visible 3D printing filament deposition lines, minor resin air bubbles, or brush stroke textures—are NOT classified as manufacturing defects. We do not accept returns, exchanges, or issue refunds based on these natural artistic or manufacturing variations. Furthermore, on-screen colors may differ slightly from the physical piece.

5. Health, Safety & Material Warnings

By purchasing from Kalaadhara, you acknowledge the physical nature of the materials used in our art and 3D prints (including thermoplastics like PLA/PETG, UV-cured resins, oil paints, varnishes, and crochet yarns).

  • Not Food or Child Safe: Unless explicitly stated otherwise in the product description, our products are NOT food safe, NOT microwave/dishwasher safe, and are NOT intended for use as toys by children. They may present choking hazards or risk of breakage if mishandled.

  • Allergy Warning: Materials used may cause allergic reactions in highly sensitive individuals.

6. Absolute Disclaimer of Warranties & Limitation of Liability

EXPRESS DISCLAIMER: To the maximum extent permitted by applicable Indian law, in no event shall Kalaadhara, Army Bhanderi, our artists, affiliates, or suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, the use of our website or physical products.

  • Assumption of Risk: You explicitly agree that your use of this site and your handling of our physical products is at your sole risk. Neither Kalaadhara nor Army Bhanderi shall be held legally or financially responsible for any bodily injury, allergic reaction, property damage, or any other intangible losses resulting from the mishandling, ingestion, breakage, or misuse of any art pieces or 3D printed articles.

  • Liability Cap: Should any liability be established by a court of law despite these terms, Kalaadhara’s total aggregate liability shall be strictly limited to the exact amount paid by you for the specific product giving rise to the dispute.

7. Indemnification

You agree to indemnify, defend, and hold harmless Kalaadhara, Army Bhanderi, and our affiliates, partners, artists, and service providers (including Shopify) from any claim, demand, or damage, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service, your misuse of our products, or your violation of any law or the rights of a third party.

8. Governing Law & Exclusive Jurisdiction

These Terms and Conditions shall be governed by and construed strictly in accordance with the laws of India. You expressly agree that any legal action, dispute, or proceeding arising out of or relating to Kalaadhara, these Terms, or your purchase shall be brought exclusively in a court of competent jurisdiction sitting in Surat, Gujarat, India.
